General Terms and Conditions – Touch Nature GmbH
1. Contractual Relationship
These General Terms and Conditions (GTC) govern the contract between you (“the Customer”) and Touch Nature GmbH, a tour operator registered in Muhen, Switzerland (UID CHE-163.413.153).
“myflyfishing” is a brand operated by Touch Nature GmbH and does not constitute an independent legal entity. All contracts are concluded with Touch Nature GmbH.
By making a booking, the Customer confirms:
that they are over 18 years of age, are authorized to act on behalf of all persons named in the booking, have read and accepted these GTC, and assume financial responsibility;
that they consent to the processing of personal data by Touch Nature GmbH, including information relating to health or dietary requirements where necessary.
2. Services and Exclusions
2.1 Final itineraries may include accommodation, meals, transfers, and activities.
2.2 Not included unless expressly stated: visa fees, travel insurance, personal expenses, gratuities.
2.3 Touch Nature GmbH and its partners may modify or withdraw services if required due to circumstances beyond their control and may pass any resulting additional costs on to the Customer.
3. Reservations and Payments
3.1 A deposit/commitment fee of 30–50% of the total price is due within 5 days of booking confirmation (flight services generally require immediate payment).
3.2 Bookings made less than 60 days before departure must be paid in full immediately.
3.3 A booking is only considered confirmed upon receipt of payment.
3.4 If payment is not made on time, the reservation will lapse without compensation.
3.5 The Customer bears all bank and credit card fees. Credit card payments require written or electronic authorization; chargebacks are expressly excluded.
4. Cancellations and Changes
4.1 Flights – Only the airline’s terms and conditions apply. In most cases, flights are non-refundable, and the full ticket price remains payable. Changes are only possible if permitted by the fare rules and are subject to fees and fare differences. Name changes are generally not allowed.
4.2 Third-party services – The terms and conditions of the respective providers apply. Many require deposits of up to 50%, which are non-refundable from the time of booking confirmation.
4.3 Touch Nature GmbH services – unless stricter conditions apply under 4.1 or 4.2:
Up to 61 days before departure: 50% of total price
60 to 31 days before departure: 90% of total price
30 days or less before departure / no-show: 100% of total price
4.4 No refunds will be made for unused services or activities that are not taken due to circumstances beyond the control of Touch Nature GmbH or by the Customer’s decision.
5. Customer Obligations
The Customer is required to:
provide valid passports, visas, vaccinations, and insurance
provide necessary personal information (health, dietary needs, weight for small aircraft)
take out comprehensive travel and medical insurance (including evacuation, hospital, and repatriation costs)
acknowledge the specific risks of travel in remote areas and proximity to wildlife and sign corresponding waivers
make all payments in full according to invoice deadlines
behave respectfully during the trip
6. Liability and Insurance
6.1 Touch Nature GmbH acts as an intermediary for third-party providers and is not liable for their acts, omissions, insolvency, or service failures.
6.2 Liability of Touch Nature GmbH is limited to gross negligence or intent in accordance with Swiss law.
6.3 Comprehensive insurance (medical, cancellation, interruption, evacuation) is mandatory. Any costs not covered by insurers are borne solely by the Customer.
7. Force Majeure
Touch Nature GmbH shall not be liable for failure to perform due to circumstances beyond its control (e.g., war, terrorism, natural disasters, epidemics, strikes, government actions, transport disruptions). In such cases, there is no entitlement to refunds or compensation.
8. Complaints
Complaints must be reported immediately to the local service provider or Touch Nature GmbH. If unresolved, a written complaint must be submitted by email no later than 5 days after the end of the trip. Failure to do so may limit claims.
9. Applicable Law and Jurisdiction
All legal relationships with Touch Nature GmbH are governed exclusively by Swiss law. The exclusive place of jurisdiction is Aarau, Switzerland. The invalidity of individual provisions does not affect the validity of the contract as a whole. Mandatory statutory provisions or international agreements remain reserved.
